On September 18, 1779, Joseph Story—one of the most influential jurists of early American history—was born in Marblehead, Massachusetts. After graduating from Harvard College in 1798, Story built a successful legal career in Salem, served in Massachusetts politics and in Congress, and was nominated by President James Madison to the U.S. Supreme Court on November 15, 1811. The Senate confirmed him and his commission was issued on November 18, 1811; he took the oath of office in February 1812. At age 32, Story became the youngest person ever appointed to serve as an Associate Justice of the Supreme Court.
Story served on the Court for more than 33 years, until his death in 1845. Alongside Chief Justice John Marshall, he became a leading advocate of a stronger national constitutional order and federal judicial authority. His opinion in Martin v. Hunter’s Lessee (1816) affirmed the Supreme Court’s appellate authority to review state-court decisions involving the federal Constitution, statutes, and treaties. His major legal treatises likewise helped organize and explain American law during the early republic, particularly in constitutional law, commercial law, equity, bailments, and conflict of laws.
Story placed particular importance on property rights and economic security within constitutional government. As he wrote, “Indeed, in a free government, almost all other rights would become utterly worthless, if the government possessed an uncontrollable power over the private fortune of every citizen.” The statement captures his belief that liberty depended not only on political rights, but also on stable legal limits against arbitrary governmental interference with private property.
Through landmark judicial opinions, prolific scholarship, and influential teaching as Harvard Law School’s Dane Professor of Law, Story spent more than three decades shaping the foundational architecture of the American legal system. He remains one of the principal architects of nineteenth-century American legal thought.
